Course: JUST 4590. Bankruptcy
Description: Provides the student with an understanding of bankruptcy
law, including such topics as creditor collection, history of bankruptcy, and
non-bankruptcy alternatives. May be offered concurrently with JUST 6590.
Expected Learning Outcomes:
We expect students completing this course to be able to:
- understand the role of the
legal assistant in a bankruptcy practice.
- understand ethical rules and
issues affecting bankruptcy practice.
- understand the types of
relief available to individuals and businesses under the Bankruptcy Code.
- understand how to gather
information from bankruptcy clients. Identify the differences between a
Chapter 7, Chapter 11, and Chapter 13 bankruptcy.
- demonstrate an understanding
of concepts relating to valuation of assets, exemptions, preferences,
reaffirmation, redemption, and dischargeability of debts.
- analyze and organize
information necessary to prepare a Chapter 7 petition and schedules,
including identifying secured, unsecured, and priority debts.
- analyze and organize
information necessary to prepare a Chapter 13 Petition, Plan, Budget, and
Schedules, including identifying secured, unsecured, and priority debts.
- demonstrate an understanding
of forms and procedures used in selected types of adversary proceedings,
contested matters, and other bankruptcy litigation.
- understand non-bankruptcy
alternatives available to debtors.
- demonstrate the ability to
communicate effectively in oral and written work.
